These Terms and Conditions govern all bookings, services, trips, and interactions provided by Firante Treks & Expeditions Pvt. Ltd. (hereinafter referred to as “Firante,” “we,” “us,” or “our”). By booking a trip, making a payment, or participating in any tour or trekking program organized by Firante, you (“the client,” “traveler,” or “participant”) agree to be bound by these Terms and Conditions.
1. Booking and Confirmation
- A booking is confirmed only after Firante receives a completed booking form and the required deposit or full payment as specified.
- Firante reserves the right to accept or decline any booking at its discretion.
- Group size, itinerary details, and services are subject to availability at the time of confirmation.
2. Payments and Pricing
- All prices are quoted in USD unless otherwise stated.
- A deposit (usually 20–30% of the total trip cost) is required to confirm a booking. The remaining balance must be paid before the trip departure date, as advised by Firante.
- Prices are based on current costs of accommodation, transportation, permits, fuel, taxes, and services. Firante reserves the right to revise prices in case of unforeseen increases beyond our control.
- Bank charges, transaction fees, and currency conversion fees are the responsibility of the client.
3. Cancellation and Refund Policy
- All cancellations must be made in writing (email or official letter).
- Cancellation charges are applied as follows (unless otherwise specified): – More than 30 days before departure: Deposit is non-refundable – 15–29 days before departure: 50% of total trip cost – Less than 14 days before departure: 100% of total trip cost
- No refunds will be provided for unused services, early departures, or voluntary trip interruptions.
- Refunds, if applicable, will be processed within a reasonable time frame after deducting applicable charges.
4. Changes to Itinerary
- Trekking and adventure travel in Nepal involve remote regions where conditions may change unexpectedly.
- Firante reserves the right to modify itineraries, routes, accommodation, or transportation due to weather conditions, safety concerns, natural disasters, political situations, or other circumstances beyond our control.
- Such changes do not entitle the client to a refund. Any additional costs arising from changes will be borne by the client.
5. Travel Insurance
- Comprehensive travel insurance is mandatory for all participants.
- Insurance must cover high-altitude trekking, emergency medical treatment, evacuation (including helicopter rescue), trip cancellation, and personal accidents.
- Firante is not responsible for any costs incurred due to inadequate or invalid insurance coverage.
6. Health, Fitness, and Safety
- Clients must be in good physical and mental health suitable for the chosen trip.
- Any pre-existing medical conditions must be disclosed at the time of booking.
- Firante reserves the right to remove a participant from a trip if their health or behavior poses a risk to themselves or others. No refunds will be issued in such cases.
- Clients must follow safety instructions provided by guides, leaders, and staff at all times.
7. Passports, Visas, and Permits
- Clients are responsible for obtaining valid passports, visas, and necessary permits.
- Firante will assist with trekking permits as included in the trip cost, but delays caused by incomplete or incorrect documents are not our responsibility.
8. Accommodation and Transportation
- Accommodation may include hotels, lodges, teahouses, or camping, depending on the itinerary.
- Standards in remote areas are basic and may differ from urban expectations.
- Transportation may include flights, jeeps, buses, or porters, subject to availability and conditions.
9. Guides, Staff, and Conduct
- Firante provides licensed guides and trained support staff.
- Clients are expected to respect local culture, customs, religion, and environment.
- Harassment, discrimination, abusive behavior, or illegal activities will not be tolerated and may result in immediate removal from the trip without refund.
10. Responsibility and Liability
- Adventure travel involves inherent risks, including but not limited to altitude sickness, weather hazards, accidents, and illness.
- By participating, clients acknowledge these risks and accept full responsibility for their participation.
- Firante, its staff, agents, and partners shall not be liable for injury, illness, death, loss, damage, delay, or inconvenience caused by events beyond our control.
11. Force Majeure
- Firante shall not be held responsible for events beyond its control, including natural disasters, pandemics, strikes, political unrest, flight cancellations, or government restrictions.
- No refunds will be issued for force majeure events, though Firante may offer alternative arrangements when feasible.
12. Photography and Marketing
- Firante may use photographs or videos taken during trips for promotional purposes.
- Clients who do not wish to appear in promotional materials must inform Firante in writing before the trip.
13. Complaints and Feedback
- Any complaints should be raised as soon as possible during the trip so that Firante can attempt to resolve the issue.
- Written complaints after the trip must be submitted within 14 days of trip completion.
14. Governing Law and Jurisdiction
- These Terms and Conditions are governed by the laws of Nepal.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of Nepal.
15. Acceptance of Terms
- By booking and participating in any trip with Firante Treks & Expeditions, clients confirm that they have read, understood, and agreed to these Terms and Conditions.
16. Booking & Cancellation Policy (Summary)
- A booking is confirmed only after receipt of the required deposit.
- Deposits are non-refundable unless otherwise stated in writing.
- Cancellation charges apply based on the date Firante receives written notice.
- No refunds are provided for unused services, missed flights, early departures, or voluntary trip interruptions.
- Firante strongly recommends purchasing insurance that covers trip cancellation and interruption.
17. Payment Policy
- Payments may be made via bank transfer or other agreed payment methods.
- All transaction, bank, and currency conversion fees are the responsibility of the client.
- Full payment must be completed before trip departure, unless otherwise agreed in writing.
- Failure to complete payment may result in cancellation of services without refund of the deposit.
18. Trip Risk & Responsibility Disclaimer
- Trekking, mountaineering, and adventure travel involve inherent risks.
- Clients participate voluntarily and accept responsibility for their actions and decisions.
- Firante is not responsible for risks arising from weather, terrain, altitude, wildlife, or unforeseen circumstances.
- Clients must follow the guide instructions at all times for safety reasons.
19. Privacy Policy
- Firante respects client privacy and protects personal information.
- Personal data is used only for booking, permits, operations, and communication.
- Information is not shared with third parties except where required for trip operations or by law.
- Clients may request correction or deletion of personal data by contacting Firante.
20. Agreement & Acknowledgement
By confirming a booking, submitting a form, or making a payment, the client acknowledges that they have read, understood, and agreed to all terms, policies, and conditions outlined above.
